SAFETY AND GEORGIA LAWS
ON 4/8/2020 SENATE BILL 140 WAS PASSED AND MADE EFFECTIVE.
The bill provides an exemption from the prohibition of fireworks usage during designated holidays. The designated holidays are Independence Day, (July 4th) New Year’s Eve (December 31st), and New Year’s Day (January 1st). It used to be that the sale and use of fireworks were generally prohibited in Georgia, unless used solely and exclusively in frightening birds from agricultural works and fish hatcheries pursuant to s. 791.07, F.S. BUT NOT ANYMORE BECAUSE IT’S LEGAL on designated holidays!
In addition, the bill is not intended to supersede any fireworks prohibition within executed and recorded covenants or covenants running with the land of a ch. 720, F.S., homeowners’ association. However, a homeowners’ association, through a board of directors, may not promulgate rules that attempt to abrogate a homeowner’s right to use fireworks during a designated holiday or under general law.
SO TO SUM IT UP… FIREWORKS ARE 100% LEGAL IN THE ENTIRE STATE OF GEORGIA, ON THE DESIGNATED HOLIDAYS (STATED ABOVE), AND NO ONE (HOMEOWNERS ASSOCIATION, ETC.) CAN SAY OTHERWISE.

- IF THERE ARE CHILDREN AROUND MAKE SURE THEY ARE BACK FAR ENOUGH WITH ADULT SUPERVISION
- KEEP PETS INDOORS.
- ENSURE TREES, ROOFLINES, AND POWERLINES ARE CLEAR FROM FLYING ITEMS.Â

- NOTIFY PEOPLE IN PLENTY OF TIME THAT YOU ARE HAVING A FIREWORK PARTY – THEY MAY NEED TO MOVE ANIMALS.
